Privacy Policy Statement
General Statement of Policy
We shall observe the requirements under the Personal Data (Privacy) Ordinance, Cap.486 (the "Ordinance") so as to comply with the measures relating to the protection of personal data under the Ordinance and will ensure our staff to observe and perform the requirements in relation to its security and confidentiality.
Types of Personal Data Collected and the Purposes for which the Personal Data are used
For the purpose of our performance of estate agency and other related works, a customer may be requested to provide with us his/her personal data including but not limited to the customer’s name, telephone number, address, contact details, identity card number and copy of any document which may contain the personal data of the customer, such as identity card, passport, bank statements and utility bills. Failure to supply such personal data by the customer may render us being unable to perform the necessary works.
The personal data provided by a customer may be used by us for the purposes of :-
- performance of estate agency works;
- promotion and marketing of services, products, and/or events of 18 Property Agency Limited and/or its affiliates, subsidiaries or associated companies;
- introducing to the customer services relating to legal, mortgage, finance, wealth management, insurance and/ or products in relation thereto (we might receive remuneration as a result of any such introduction);
- compliance with the laws of Hong Kong SAR (including the Estate Agents Ordinance and its subsidiary legislations and regulations);
- prevention of money laundering;
- collection of any sum of money due to us by the customer;
- legal proceedings and/or enforcement of judgments and/or orders; and/or
- purposes relating to any of the above.
Disclosure and Transfer of Personal Data
All personal data of a customer held by us will be kept confidential. However, we may disclose and/ or transfer personal data of the customer to the following parties:-
- the agents, contractors and/or services providers who provide services to us in connection with our business, operation and/or development;
- co-operative estate agents;
- any affiliates, subsidiaries or associated companies of 18 Property Agency Limited;
- law firms, banks, financial institutions, insurance companies, mortgage referral service providers and/or wealth management service providers (we might receive remuneration as a result of any such introduction);
- government agencies, regulatory bodies and/or other statutory authorities;
- courts, tribunals and/or parties to the legal proceedings; and/or
- debt collection agencies or debt recovery organizations.
Security and Retention of Personal Data
We have adopted an electronic security system to prevent unauthorized access to personal data. Personal data of a customer will be retained by us for 7 years (commencing from the date of an estate agency agreement or a provisional agreement for sale and purchase (tenancy), whichever is later) or such longer period as prescribed by applicable laws and such guidelines, practice circulars, code of ethics and practice directions issued by the regulatory authorities and applicable to us.
Direct Marketing
We will cease to use the personal data of a customer for direct marketing if the customer so requests. A customer who does not wish to receive direct marketing calls or materials may write to our Data Protection Officer at [wingchiu@18-property.com] or by post to Room 2107, Block B, New Trade Plaza, 6 On Ping Street, Shatin, New Territories, Hong Kong.
Access to and Correction of Personal Data
A customer is entitled to have access to and/or correct his/her personal data. Accordingly, the customer may write to our Data Protection Officer at [18-property@18-property.com] or by post to Room 2107, Block B, New Trade Plaza, 6 On Ping Street, Shatin, New Territories, Hong Kong. In accordance with the Ordinance, we are entitled to charge a reasonable fee for the processing of any data access request.
